1. General Agreement & Governing Law

These Terms and Conditions govern all bookings, activities, and services provided by Fun Divers Zanzibar (“the Company”, “we”, “us”, or “our”).

By making a booking, participating in any activity, or using our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

These Terms shall be governed by and interpreted in accordance with the laws of Zanzibar and the United Republic of Tanzania. Any disputes arising shall fall under the jurisdiction of the competent courts of Zanzibar.


2. Pricing, Inclusions & Exclusions

All prices are quoted per person and are non-transferable and non-shareable.

Inclusions

Unless otherwise stated, dive packages include:

  • Boat dives

  • Professional dive guide/instructor

  • Surface interval refreshments

  • PADI eLearning and certification fees (where applicable)

Complimentary Equipment

Full scuba equipment is provided at no additional cost, including:
mask, fins, weights, BCD, regulator, and wetsuit.

The use of personal equipment does not reduce the package price.

Exclusions

Dive computers are not included or rented. Divers are responsible for providing their own where required.


3. Payment Methods & Fees

We accept the following payment methods:

  • Cash (USD, EUR, or Tanzanian Shillings)

  • Credit/Debit Cards (Visa & Mastercard)

  • Secure online payments via Direct Pay Online (DPO)

A 3% processing fee applies to all card and online transactions.

All payments must be completed in accordance with the applicable booking schedule.


4. Booking Requirements

All certified divers must:

  • Present valid proof of certification

  • Provide certification level and certification card

  • Declare number of logged dives

  • Provide date of last dive

Failure to provide accurate information may result in refusal of service without refund.


5. Medical, Fitness & Age Requirements

Scuba diving is a physically demanding activity undertaken at your own risk.

All participants must:

  • Complete a PADI Diver Medical Questionnaire

  • Disclose all relevant medical conditions honestly

Age Restrictions

  • Minimum age: 10 years

  • Divers aged 60 years and older must provide written medical clearance from a certified diving physician

The Company reserves the right to refuse participation based on health, fitness, or safety concerns.


6. Safety, Conduct & Right of Refusal

Safety is our highest priority.

Fun Divers Zanzibar reserves the absolute right to:

  • Refuse service

  • Cancel or modify dives

  • Change dive sites or schedules

at any time if safety, weather, or operational conditions require it.

Participants must:

  • Be able to swim competently

  • Follow all instructions and dive briefings

  • Maintain safe diving practices

  • Communicate effectively in English or Swahili

Prohibited Conduct

  • Use of alcohol or drugs before or during activities

  • Dangerous or reckless behaviour

Any violation may result in immediate exclusion without refund.


7. Liability, Risk & Insurance

Assumption of Risk

Scuba diving and related activities involve inherent risks including serious injury or death.

All participants are required to sign a PADI Liability Release and Assumption of Risk Agreement prior to participation.

Limitation of Liability

To the fullest extent permitted by law, Fun Divers Zanzibar shall not be held liable for:

  • Personal injury, illness, or death

  • Loss or damage to personal belongings

  • Delays, cancellations, or changes due to external factors

Insurance

Participants are strongly advised to hold valid insurance covering:

  • Scuba diving activities

  • Hyperbaric treatment

  • Emergency evacuation

Emergency Evacuation

All costs related to medical treatment, evacuation, or repatriation remain the sole responsibility of the participant.


8. Environmental Responsibility

We operate a strict no-touch, eco-conscious diving policy.

Participants must not:

  • Touch or damage coral reefs

  • Harass marine life

  • Interfere with the natural environment

Violation may result in termination of services without refund.


9. Force Majeure

The Company shall not be held liable for failure or delay in performance due to circumstances beyond its control, including but not limited to:

  • Weather conditions

  • Government restrictions

  • Mechanical failures

  • Natural disasters
